The Private Passenger Auto Insurance Market is Changing at a Rapid Pace.  The top four private passenger auto insurers - State Farm, GEICO, Progressive and All State -- have recorded record profits over the past three years, but have become increasingly aggressive in grossly underpaying on valid claims prior to litigation.  These insurers frequenlty offer a plaintiff a full settlement amount that is roughly equal to the amount of the plaintiff's medical bills.

Insurers also approach the valuation of a claim by asserting that the amount of the incurred medical expenses is inflated and that the insurer should be liable only for a lower "more reasonable" rate.  This is a rational strategy for the insurer economically for two key reasons:

  • Secondly, the amount of medical expenses is the most convincing factor in calculating and negotiating and award to the plaintiff for his or her pain and suffering.  So, the insurance company attempts to reduce the agreed amount of medical expenses also for the purpose of negotiating a lower pain and suffering award.
